Description

In February 2023, the General Directorate of Cultural Heritage will entrust the Catalan Cultural Heritage Research Institute (ICRPC) with the preparation of the Preliminary Report of the avant-project of the Catalan Cultural Heritage Law and the review and harmonization of the existing documents in the department for the updating of the text of the avantprojecte de llei del patrimoni cultural català.

The Preliminary Report of the preliminary draft of the new Catalan cultural heritage law, objective included in the Government Plan of the XIV Legislature, will be submitted by the ICRPC to the General Directorate of Cultural Heritage in June 2023. After the internal review process, it will be approved by the Government on December 19, 2023.

This document is the result of the process of harmonizing, updating and reviewing the proposals that the different units and equipment assigned to the General Directorate of Cultural Heritage have prepared any 20142.015 and reviewed in 2022, mainly for an update of the law.

The text presented below is the fruit of the analysis and assessment of the considerations fetes by the units in those years, and is going to share and estimate through face-to-face meetings with the services and units that manage the architectural heritage, the archaeological, the museums, the documentation and the archives, together with each other. The following equipment: the Béns Mobles de Catalunya Restoration Center, the National Archive of Catalonia and the Library of Catalonia.

Based on a unified and contrasted document of the proposed fetes by the units, the ICRPC work team will contribute considerations and proposals to the debate within the General Directorate of Cultural Heritage, with the objective that the new text can donate responds to the reptes and opportunities of cultural heritage in the 21st century, it is the new law Paller of the sectoral legislation in cultural heritage and, as has been the case of the Law 9/93, has a temporary review of a generation.

Fruit of the work together with those responsible for the units and the material General Directorate of Cultural Heritage, the proposals presented have been transformed into the form of articulat de Llei. To elaborate this proposal, in addition to the proposed Spanish methodology, the current legislation on cultural heritage has to be presented to the Spanish State, and it has to guarantee that everything regulated by Law 9/93 continues to protect or millorat.

The approval protocol of the Law requires a participatory process between the representative entities of the sector, the local entities and other organizations and institutions. Consider that the contingut of the Avantprojecte will constitute a good starting point to contrast, refine or expand the contingut of the articles and its structure.
